Businessman gets 3 years for embezzling regional budget

Businessman Fresh Lande was convicted of embezzling Rp 1.5 billion [$US165,000] of state funds and sentenced to three years in prison by the Makassar District Court on Wednesday.

The judges unanimously agreed that Lande had embezzled the money from the Pare-pare budget when he worked as director of PT Pares Bandar Madani, a joint venture he founded with the regional government.

Lande was given one month to pay the state Rp 1.17 billion in restitution or face confiscation of his personal wealth. He will have to pay Rp 150 million in fines or serve an extra two months in prison.

Landes had agreed invest Rp 750 million in Pares Bandar Madani, later discovered to be a fictitious company. Pares Bandar Madani’s start-up capital came from the regional budget.

The Supreme Audit Agency said Rp 1.2 billion was still missing.

Landes said he would appeal the court ruling, which he said was too severe. State prosecutors had sought a four-year prison sentence.

Makassar mayor Zain Katoe and the company’s operational head Umar Usman are also standing trial in the same case.
